And the Diamond Debtors seem to be issuing these new adversary proceedings in alphabetical order. As of publication, they have filed against Ablaze, Action Lab Entertainment, AfterShock Comics, Alien Books, American Mythology Productions, Aspen MLT, Battle Quest Comics, Black Mask, Boom Studios, Dark Horse Comics, Digital Manga, Dstlry , and Dynamite Entertainment . UPDATE: And now Fantagraphics , Goodman Games, Green Ronin Publishing, Heavy Metal Media, Hermes Press, Humanoid, Inc., Living the Line, Magnetic Press, Massive Publishing, Netcomics, Oni Press, Paizo, Panini UK, Titan Comics, Udon Studios, Valiant Entertainment, Vault Storyworks and Zenescope.
Hmmm…seemed to have skipped over Marvel, DC, IDW…either they are not debtors, or Diamond is going after the bottom feeders first…not testing companies with likely better lawyers…
The filing from the Diamond Debtors accuses the publishers of failing to properly secure their interest in the consigned goods by filing a UCC-1 financing statement with the Maryland Department of Assessments and Taxation, and that this oversight leaves the inventory vulnerable to claims by its creditors, effectively making it part of the bankruptcy estate.
Ah…the old “morally we should have identified this oversight out to you at any time before declaring bankruptcy, but did not as it was to our advantage” loop hole.
Wouldn’t necessarily say better… just lawyers likely already on staff at the bigger ones! All about money at this point, don’t go after the big guys with way more money who can drown you in legal fees with zero chance of winning.
No Image either. The only reason I could see that they are not mentioned is that Diamond has always liquidated those publisher’s backstock. They must have already had some kind of contractual agreement in place for handling backstock whereas the smaller publishers didn’t.
Diamond worked out a deal with Image. Image got some books and let Diamond liquidate others, as far I recall reading. Everyone else is being sued by Diamond, however. The company is just a zombie at this point, animated only by lawsuits.
