Maybe, seems like it falls under derivative works but I think they’d still need to get permission, so yes, someone from both DC and Marvel could come after them if they did not get permission.

Also most of this art looks like it’s just AI generated…

They could claim it’s a parody and probably get away with it.

It’s the parody paradox. This seems like it would be covered under parody just the same way Adam Hughes earliest Work was on derivative works but covered under parody

The other thing that occurs to me is the can claim it is fan created or artist created for personal use. Remember, you don’t buy anything on Kickstarter. You fund projects. Anything you receive from Kickstarter is a reward for funding a project at a certain level. And even then the rewards are not guaranteed. So who knows. Would make an interesting court case.

To add to the paradox, Disney suing would draw more attention to it. If copyright infringements are barely making any money or could be argued as parody/private use/whatever it is maybe best to just ignore it. Like how Disney didn’t bother suing that guy who filmed a horror movie with scenes in the park without their permission, figuring the least amount of press it got the better. It barely made an impact as a result.
